1. About Bit & Co.

Bit & Co. is an online marketplace that connects people who buy and sell equestrian products and services. We are an intermediary platform only. We do not own, inspect, store, ship or guarantee any item or service listed by our members.

2. Accounts

You must be at least 18 years old to create an account. You are responsible for keeping your login details secure and for all activity that happens under your account. Provide accurate information and keep it up to date.

3. Listings and seller responsibility

Sellers are solely responsible for their listings, including descriptions, photographs, pricing, condition and defects, availability, shipping, returns, refunds, taxes, licenses and compliance with all applicable laws. Bit & Co. does not verify listings and makes no representation about any item or service offered.

4. Transactions between users

Any contract of sale is formed directly between the buyer and the seller. Bit & Co. is not a party to that contract and has no obligation to intervene in disputes, although we may choose to help resolve them at our discretion.

5. Fees and payments

Creating an account and listing is free. Bit & Co. retains a platform fee of 5% of the product subtotal (excluding shipping) plus $0.70 per completed order. Services and horse classifieds do not use product checkout. Product sellers receive direct payments through their own connected Stripe accounts and pay Stripe processing fees from their balances, in addition to the platform commission. Sellers are the merchants of record and are responsible for refunds, disputes and applicable fees under Stripe's terms. Shipping labels purchased from a seller's carrier or Shippo account are billed directly to the seller, including applicable label fees and subsequent carrier adjustments.

6. Prohibited conduct

• Listing prohibited or illegal items (see our Prohibited Items policy).
• Misrepresenting an item, service, price or your identity.
• Arranging payment outside the platform to avoid fees.
• Harassment, spam, scraping, or attempts to disrupt the service.
• Posting content you do not own or have the right to use.

7. Reviews and ratings

Reviews reflect the personal opinions of members, not those of Bit & Co. We may remove reviews that are abusive, fraudulent or unrelated to an actual transaction.

8. Suspension and termination

We may suspend, limit or close any account, and remove any listing, at any time, if we believe these Terms or applicable law have been breached, or to protect the community.

9. Disclaimer of warranties

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, Bit & Co. is not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill arising from your use of the marketplace or from any transaction between members. Our total liability for any claim is limited to the platform fees you paid us in the twelve months before the claim arose.

11. Indemnification

You agree to indemnify and hold Bit & Co. harmless from any claim, loss or expense arising out of your listings, your transactions, your content or your breach of these Terms.

12. Changes and governing law

We may update these Terms; continued use of the marketplace means you accept the updated version. These Terms are governed by the laws of the United States and of the state in which Bit & Co. is established, without regard to conflict-of-law rules.
